These Terms of Service (“Terms”) govern your access to and use of odddrop.com and any purchase from OddDrop. OddDrop Inc. (“OddDrop,” “we,” “us,” or “our”) operates the site and is the seller of products purchased through it.
By using the site or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the site. Nothing in these Terms limits rights that cannot lawfully be limited, including mandatory consumer rights in the country where you live.
1. Eligibility and Accounts
You must be legally capable of entering a binding contract to place an order. If you are not, a parent or legal guardian must make the purchase for you. You must provide accurate, current, and complete information and keep account credentials confidential. You are responsible for activity under your account except to the extent caused by our breach of law or these Terms.
We may suspend or restrict an account where reasonably necessary to protect the site, customers, payment systems, or our legal rights—for example, in response to suspected fraud, abuse, unauthorized access, or material violation of these Terms.
2. Products and Product Information
We aim to describe products accurately. Colors and appearance may vary slightly because of screen settings, lighting, manufacturing batches, or handmade characteristics. Dimensions stated as approximate may have reasonable production tolerances. Product packaging may differ from website images where the difference does not materially change the product. These statements do not reduce your rights where a product is defective, unsafe, materially misdescribed, or not of satisfactory quality.
Product availability is not guaranteed. We may change or discontinue products prospectively. Any material product restrictions, compatibility requirements, age or safety warnings, included accessories, compatibility information, and other material restrictions should be stated on the relevant product page.
Third-Party Brands and Character References
Third-party names, characters, logos, and trademarks belong to their respective owners. A reference to a third-party brand or franchise identifies or describes a product and does not by itself imply sponsorship, endorsement, or affiliation. A product will be described as “official” or “licensed” only where we have a reasonable basis to make that claim.
3. Prices, Promotions, Currency, and Taxes
Prices and promotions shown on the site may change before you place an order. The price charged is the price displayed at checkout when you submit the order, subject to correction of an obvious error as described below. Checkout will show available delivery charges and any taxes collected by us before payment.
If your card or payment account uses a different currency, your provider may apply conversion rates or fees that we do not control. Unless an amount is expressly collected at checkout, you are responsible for taxes, import duties, customs charges, and carrier handling fees imposed in connection with your purchase or importation. These amounts are not included in the product price or shipping charge unless expressly stated. We do not control charges imposed by governments, banks, carriers, or payment providers. Nothing in this section relieves OddDrop of any tax collection, reporting, or remittance obligation that applicable law places on us.
Promotion terms displayed with an offer form part of these Terms. Unless the offer states otherwise, promotions cannot be combined, have no cash value, and may be limited by time, product, territory, or stock. We will not change a completed purchase solely because a promotion later ends.
4. Orders and Contract Formation
Your order is an offer to buy. An automated order acknowledgment confirms that we received the order; it does not necessarily mean the order has been accepted. Unless mandatory law provides otherwise, acceptance occurs when we send a dispatch confirmation or otherwise expressly accept the order.
Before acceptance, we may refuse or cancel an order for a legitimate reason, including:
- the product is unavailable;
- payment is not authorized or information cannot reasonably be verified;
- we reasonably suspect fraud, unauthorized resale, abuse, sanctions risk, or a violation of these Terms;
- we cannot deliver to the address or destination; or
- the price or product information contains an obvious and material error that a reasonable customer would recognize.
If we cancel after taking payment, we will refund the amount paid for the cancelled item and any associated delivery charge that is no longer applicable. We may limit quantities on a reasonable and non-discriminatory basis to protect limited inventory or prevent unauthorized resale.
5. Payments, Verification, and Chargebacks
Payment is processed through Shopify and the payment option selected at checkout, which may include payment-card providers, PayPal, Shop Pay, or Apple Pay. Payment providers may apply their own terms and privacy notices. By submitting payment details, you represent that you are authorized to use that payment method and authorize the applicable charges.
We and our payment or fraud-prevention providers may conduct lawful verification checks. We may place an order on hold while resolving a reasonable payment or identity concern. If you believe a charge is incorrect, contact service@odddrop.com promptly so we can investigate. Nothing in this section limits rights provided by your payment provider or applicable law.
6. Shipping and Delivery
Orders are dispatched within seven calendar days after payment is successfully confirmed. Delivery time begins after dispatch and varies by destination, carrier, customs processing, and local conditions. Current delivery estimates, tracking information, and shipping charges are described in our Shipping Policy. Delivery estimates are not guaranteed dates unless we expressly agree otherwise or mandatory law provides otherwise.
If we cannot dispatch an order within seven calendar days, we will notify you and provide any cancellation or refund option required by applicable law.
You are responsible for providing a complete and accurate delivery address. If you notice an error, contact us immediately. We cannot promise that an address can be changed after fulfillment begins. Responsibility for loss or damage transfers as provided by applicable consumer law; these Terms do not shift to a consumer any delivery risk that the law requires us to bear.
If a parcel is delayed, missing, damaged, or marked delivered but not received, contact us with your order number. We may ask for reasonable information needed to investigate with the carrier. Your remedies remain subject to applicable law.
7. Cancellations, Returns, Refunds, and Faulty Goods
Our voluntary return program is described in our Returns & Refunds Policy. It currently permits returns of unused items in original packaging within 30 days of delivery, subject to the stated conditions and lawful exclusions.
Opened blind-box products, personalized goods, and other identified items may be excluded from voluntary change-of-mind returns where permitted by law. This does not remove remedies for products that are defective, unsafe, materially misdescribed, incorrect, damaged on arrival, or otherwise protected by mandatory law.
Consumers in some locations have statutory cancellation rights for online purchases. For example, qualifying EEA and UK consumers generally have a 14-day withdrawal period for many distance purchases, subject to legal exceptions. Where those rights apply, our voluntary policy supplements and does not replace them. We will provide legally required refunds, delivery-cost treatment, return instructions, and model withdrawal information where applicable.
Approved refunds are normally returned to the original payment method. Banks and payment providers control how long a posted refund takes to appear. Refund timing statements do not limit statutory deadlines.
8. Reviews and Other User Content
If you submit a review, photograph, comment, or other content, you retain ownership of your content. You grant OddDrop a non-exclusive, worldwide, royalty-free license to host, reproduce, format, translate, publish, and display it in connection with the Services, marketing, and customer support, for as long as reasonably necessary for those purposes, subject to applicable privacy law.
You represent that you have the rights needed to submit the content and that it is honest, lawful, and does not infringe another person’s rights. We may moderate or remove content for a legitimate reason, including illegality, harassment, spam, undisclosed incentives, personal information, or intellectual-property infringement. We will not suppress a genuine negative review merely because it is unfavorable.
9. Acceptable Use
You must not:
- use the site for unlawful, fraudulent, abusive, or deceptive activity;
- interfere with security, checkout, accounts, or site operation;
- introduce malware, scrape the site at a harmful rate, or attempt unauthorized access;
- misuse promotions, reviews, returns, payment disputes, or customer accounts;
- infringe intellectual-property, privacy, publicity, or other rights; or
- use automated means to purchase limited inventory where prohibited by displayed sale rules or applicable law.
10. Intellectual Property
The OddDrop name, site design, original text, graphics, photographs, software, and other content owned by us or licensed to us are protected by applicable intellectual-property law. We grant you a limited, revocable, non-transferable right to access the site for personal, non-commercial shopping use. No other license is granted.
If you believe content or a product listing infringes your rights, email service@odddrop.com with identification of the protected work, the material at issue, your contact details, a statement of your good-faith belief, and evidence that you are authorized to act.
11. Third-Party Services and Links
The site may use or link to third-party services, including Shopify, payment providers, carriers, social networks, and review platforms. We are not responsible for a third party’s independent services, content, or policies. This does not exclude responsibility that applicable law places on us for providers acting on our behalf.
12. Privacy
Our collection and use of personal information are described in our Privacy Policy. The Privacy Policy also explains available privacy choices and rights.
13. Disclaimers
To the maximum extent permitted by law, the site is provided on an “as available” basis. We do not promise that the site will always be uninterrupted, error-free, or compatible with every device. Product-specific warranties, if any, will be disclosed on the relevant product page or with the product.
Nothing in these Terms excludes implied warranties, statutory guarantees, remedies for defective or unsafe products, or other consumer protections that cannot lawfully be excluded.
14. Limitation of Liability
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, willful misconduct, gross negligence where it cannot be limited, breach of mandatory consumer law, or any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above and to the maximum extent permitted by law, OddDrop will not be liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed. For a claim arising from a product or order, our aggregate liability will not exceed the amount you paid for the affected order, except where applicable law provides a greater remedy. This limitation does not affect your right to a refund, repair, replacement, or other mandatory consumer remedy.
15. Your Responsibility for Misuse
To the extent permitted by law, you are responsible for losses and reasonable costs directly resulting from your unlawful misuse of the Services, your fraudulent conduct, or content you submit in violation of Section 8. This section does not apply to ordinary consumer use or reduce any mandatory consumer right.
16. Events Outside Reasonable Control
We are not responsible for delay or failure caused by events outside our reasonable control, such as natural disasters, war, civil unrest, epidemics, government action, customs disruption, carrier shutdowns, labor disputes, infrastructure failure, or cyberattacks. We will take reasonable steps to reduce the effect and will provide cancellation or refund rights required by law.
17. Governing Law and Disputes
These Terms and any dispute arising from the site or a purchase are governed by the law that applies under applicable conflict-of-law and consumer-protection rules. A claim may be brought before any court or dispute-resolution body that has jurisdiction under applicable law.
If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your habitual residence, and you may bring a claim in any court available to you under mandatory law. Before filing a claim, we encourage you to contact service@odddrop.com so we can try to resolve the issue informally. This does not pause any statutory limitation period unless the law says otherwise.
18. Changes to These Terms
We may update these Terms prospectively to reflect changes in law, our Services, or business practices. The updated Terms will be posted with a revised effective date. Changes will not retroactively reduce rights for an order already accepted unless the law permits and we obtain any required consent.
19. General Terms
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver. We may assign these Terms in connection with a merger, reorganization, or sale of our business, provided this does not reduce mandatory consumer rights. You may not assign an account or order without our consent where doing so would materially affect our obligations.
These Terms, together with the product page, order confirmation, Privacy Policy, Shipping Policy, Returns & Refunds Policy, and any displayed promotion terms form the agreement between you and OddDrop for the relevant use or purchase. If documents conflict, mandatory law controls, followed by product- or order-specific terms, then these Terms.
